Khula Terms of Service

Welcome to Khula. These Terms of Service ("Terms") govern your access to and use of Khula's website, applications, and services (collectively, the "Service"), operated by Khula Technologies Limited, a company incorporated in the Federal Republic of Nigeria ("Khula", "we", "us", or "our"). By accessing or using Khula, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years old to use Khula. By using the Service, you represent and warrant that:
- You meet this age requirement
- You have the legal capacity to enter into binding contracts
- Your use of the Service does not violate any applicable laws
2. Service Availability
Khula is provided on the following basis:
- The Service is provided "as is" and "as available" without warranties of any kind
- Features may be added, modified, or removed without notice
- Downtime, errors, bugs, or data loss may occur
- Service levels and availability are not guaranteed unless separately agreed in writing
- Publishing depends on third-party social media platforms, whose APIs may change, rate-limit, or fail outside our control
You acknowledge and accept these risks by using the Service.
3. User Accounts & Security
3.1 Account Creation
To use Khula, you must create an account and may need to connect third-party social media accounts.
3.2 Your Responsibilities
You are solely responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring the accuracy and legality of information you provide
- Notifying us immediately of any unauthorized access
3.3 Account Deletion
You may request account deletion at any time by contacting support@khula.app. We will process deletion requests within 30 days, subject to legal retention requirements.
4. Content & Intellectual Property
4.1 Your Content
You retain all ownership rights to content you create, upload, or schedule through Khula ("User Content").
4.2 License to Khula
By using the Service, you grant Khula a limited, non-exclusive, worldwide, royalty-free license to:
- Store, process, and transmit your User Content
- Display your User Content as necessary to provide the Service
- Make technical copies and backups
This license exists solely to operate the Service and terminates when you delete content or close your account.
4.3 Khula's IP
All rights, title, and interest in the Service, including software, designs, trademarks, and branding, remain the exclusive property of Khula Technologies Limited.
5. Acceptable Use Policy
You agree NOT to use Khula to:
- Violate any local, national, or international laws or regulations
- Infringe intellectual property rights of any third party
- Post, share, or schedule illegal, harmful, defamatory, or abusive content
- Engage in spam, phishing, or deceptive practices
- Harass, threaten, or impersonate others
- Distribute malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems
- Violate the terms of service or policies of connected third-party platforms
- Use the Service for any unlawful or fraudulent purpose
We reserve the right to suspend or terminate accounts that violate this policy, with or without notice.
6. Third-Party Platform Integration
6.1 Platform Connections
Khula integrates with third-party social media platforms including but not limited to Facebook, Instagram, TikTok, YouTube, LinkedIn, and Twitter/X.
6.2 No Affiliation
Khula is not affiliated with, endorsed by, or sponsored by any of these platforms.
6.3 Your Responsibility
You acknowledge that:
- Platform availability, API functionality, or features may change without notice
- You must comply with each platform's terms of service and community guidelines
- Khula cannot guarantee successful posting due to platform-side restrictions
- Platform policy violations may result in account restrictions by those platforms
6.4 Limitation of Liability
Khula is not liable for any issues, failures, account suspensions, or data loss caused by third-party platforms.
7. Free Trial, Subscriptions & Payment
7.1 Free Trial
New accounts receive a 30-day free trial with full access to the features of the selected plan. No payment details are required to start the trial. At the end of the trial your account will not be charged automatically — you must choose a plan and provide payment details to continue using paid features.
7.2 Subscriptions
Paid plans are billed in advance, monthly or annually depending on the billing period you select, and renew automatically at the end of each period until cancelled. Prices are displayed in Nigerian Naira (NGN) or United States Dollars (USD) depending on your location, and are exclusive of any applicable taxes unless stated otherwise.
7.3 Cancellation
You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you keep access to paid features until then.
7.4 Refunds
Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partially used billing periods.
7.5 Price Changes
We may change subscription prices. Any change takes effect at your next renewal, and we will give you at least 30 days' notice by email before it applies.
7.6 Failed Payments
If a payment fails, we may suspend access to paid features until payment succeeds. Accounts left unpaid may be downgraded or closed after reasonable notice.
